Terms of Use

The rules for using First Roth.

Agreement

These Terms of Use (“Terms”) apply to the First Roth app (“the app”), published by Chore Coach LLC, doing business as Lindon Digital (“we”, “us”). By downloading or using the app, you agree to these Terms and to Apple’s Licensed Application End User License Agreement (“Apple EULA”). If these Terms conflict with the Apple EULA, the Apple EULA applies to the extent of the conflict.

What First Roth does

First Roth is a record-keeping tool. It helps you record work your child does, your approvals, and the pay you send; fills in a W-2 worksheet from your records; creates year-end records for your tax preparer; and estimates your child’s Roth IRA contribution room.

First Roth does not run payroll, withhold or pay taxes, move money, open accounts, file W-2s or tax returns, or act on your behalf with any government agency or financial institution.

Your responsibilities

You are responsible for deciding whether your child’s work is real employment, for paying reasonable wages for work actually done, for the accuracy of everything you record, and for meeting every federal, state, and local tax, payroll, and filing obligation — including your child’s own tax return and any state work-permit rules. Review every W-2 worksheet before you use it.

Who may use First Roth

You must be at least 18 years old and the parent or legal guardian of any child whose information you enter, with the authority to enter it. You use the app on behalf of yourself and your household, not on behalf of others.

Records, time stamps, and location stamps

Time stamps come from your device’s clock and time-zone settings, and location stamps come from your device’s location services and Apple’s map data. They can be wrong, missing, or imprecise — for example because the device clock or time zone was set incorrectly or changed, daylight-saving changes, travel across time zones, weak GPS signal, location services being turned off, or an address lookup returning a nearby address. We do not verify, certify, or guarantee any time, date, place, photo, or record, and a stamp is not proof that work was done. You are responsible for checking every record and correcting errors.

Permissions are optional

Camera, photo library, and location access are optional. You choose whether to allow them and can turn them off at any time in the app or in iPhone Settings. If you turn them off, some records will not include photos or places; that is your choice and does not make the app defective.

Your data, backups, and devices

Your records are stored only on your device. We do not hold a copy and cannot recover them. Records can be lost if your device is lost, damaged, reset, or replaced, if you delete the app, if iCloud Backup is off or incomplete, or because of a software error. You are responsible for backing up your device and for exporting and keeping the records you need, for as long as tax rules require. The app’s backup feature creates a file you store where you choose (and, if offered, in your own iCloud account, kept by Apple under its terms); we do not guarantee that any backup is complete or can be restored. You are responsible for the security of your device and of any file you export or share, including W-2 worksheets that contain Social Security numbers.

Calculations, limits, and reminders

Amounts, contribution room, thresholds, deadlines, and reminders are estimates based on the information you enter and on rules as we understood them when the app was last updated. Laws, limits, and agency procedures change, state and local rules vary, and the app may be out of date or incomplete. Do not rely on the app as your only source for any amount or deadline, and do not rely on reminders being delivered.

Work, safety, and child-labor rules

First Roth does not assign, supervise, or inspect any work. You alone decide what work your child does and are solely responsible for their safety and supervision, for any injury or damage that happens during work, for insurance, and for complying with child-labor, work-permit, wage, and workers’ compensation laws where you live.

Taxes, audits, and retirement accounts

You are solely responsible for whether wages are reportable, deductible, or treated as compensation; for every return, payroll filing, and payment, and their deadlines; and for any tax, penalty, interest, or reclassification by the IRS or any state, including if wages are treated as a gift or allowance. You are responsible for Roth IRA eligibility and contribution amounts, including any excess-contribution tax. Investments can lose value; we do not choose or recommend investments.

Family Pro subscription

The app has a free version. Family Pro is a yearly auto-renewing subscription purchased through your Apple Account. Eligible new subscribers may receive an introductory price for the first year; after that it renews at the standard yearly price shown in the app unless you cancel at least 24 hours before the end of the current period. Manage or cancel in iPhone Settings › Apple Account › Subscriptions. Refunds are handled by Apple under its policies.

License and acceptable use

We grant you a personal, non-exclusive, non-transferable license to use the app on Apple devices you own or control, as permitted by the Apple EULA. You agree not to copy, modify, reverse engineer, or redistribute the app, or use it in any unlawful way. First Roth, its design, and its content are owned by Chore Coach LLC.

Disclaimer of warranties

The app is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We do not guarantee any tax result, deduction, Roth IRA eligibility, or outcome of an audit; that any record, stamp, calculation, or document is accurate or complete or will be accepted by any agency; or that the app will be uninterrupted, secure, or error-free. We may change, suspend, or discontinue the app or any feature at any time.

Limitation of liability

To the fullest extent permitted by law, Chore Coach LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, including taxes, penalties, interest, or loss of data, arising from your use of the app. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us for the app in the 12 months before the claim or US $50.

Third-party services

The app relies on Apple’s operating system, App Store, iCloud, and map services, and links to banks and brokerages. We are not responsible for their availability, accuracy, fees, security, decisions, or actions, or for any account you open with them.

Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Chore Coach LLC and its owners, members, and contractors from any claim, loss, tax, penalty, or expense (including reasonable attorneys’ fees) arising from your use of the app, your records, your employment of or payments to your child, your tax and payroll filings, or your breach of these Terms.

Disputes: informal resolution, arbitration, and class-action waiver

Before filing any claim, you agree to contact us at support@firstroth.com and try to resolve it informally for 60 days. Any dispute not resolved informally will be decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court. You and we waive any right to a jury trial and to bring or join a class or representative action. You may opt out of arbitration by emailing us within 30 days after you first accept these Terms. Any claim must be brought within one year after it arises, to the extent the law allows.

General

If any part of these Terms is found unenforceable, the rest remains in effect and that part will be enforced to the maximum extent allowed. These Terms (with the Apple EULA and our Privacy Policy) are the entire agreement between you and us about the app. Our not enforcing a term is not a waiver. We are not liable for delays or failures caused by events beyond our reasonable control. The English version of these Terms controls.

Changes and termination

We may update these Terms and will post the new version on this page with a new effective date. Continuing to use the app after an update means you accept the updated Terms. You may stop using the app at any time by deleting it.

Governing law

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law rules, except where the law of your place of residence requires otherwise. Subject to the arbitration section, any court proceeding will be brought in the state or federal courts located in King County, Washington.
